Frequently Asked Questions

  • How does the judgment collection process work?
    • First, we enter into an agreement covering terms of the assignment of the judgment. Then the judgment is legally assigned to us, making us the judgment creditor. This enables us to pursue the debtor and his assets. After finding where the debtor is and what he has, we determine what legal methods will be successful in collecting what is owed.

  • Who pays for the expenses of the collection process?
    • JUDGMENT RECOVERY LLC ADVANCES ALL OF THE COSTS OF THE COLLECTION PROCESS. We petition the court to have all allowable expenses included in the judgment so that the debtor ultimately pays them.

  • How long is it before results are seen?
    • The time period can vary greatly. The difficulty in locating the debtor and uncovering his assets determine the time required for recovery. In some cases, results can be seen within 90 days. Other cases can take much longer.

  • Is there any guarantee that JUDGMENT RECOVERY LLC will be able to collect a judgment?
    • No. Sometimes there are just no assets to seize. We will do our best because we are paid only if we recover funds.

  • Is there a statute of limitations on collecting a judgment?
    • In most states judgments must be enforced within ten years. This can be extended by petitioning the court.

  • What about using an attorney to collect my judgment?
    • You can use an attorney if you are willing to pay a retainer and a fee of between approximately $150.00 and $200.00 per hour whether they collect anything or not.

  • How about using a collection agency?
    • A collection agency normally contacts a debtor by phone and mail. This process attempts to irritate him to the point of collecting something. The agency may even record a black mark on the debtor's credit report. They rarely recover funds.

  • Can't I recover my own judgment?
    • Yes. Chances are, you have already tried. JUDGMENT RECOVERY LLC is a judgment recovery specialist. Our business is collection from difficult debtors. We have the skills and resources to locate debtors, their assets and employment. Then we can seize and garnish to satisfy the judgment.

  • I have a judgment awarded in one state against a debtor who resides in another state. Can you help?
    • Yes. You will need to get a “Sister State” judgment and have your judgment domesticated in the state in which the debtor resides. This is not a complicated process. Domestication papers need to be filed and fees to be paid. Contact us to discuss how we can be of assistance.
